1. Acceptance of These Terms
By accessing an Empire Builder Hub event page, registering for an event, or using related services, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the page or submit a registration.
2. Event Registration
You agree to provide accurate, current information and to use event access details only for their intended purpose. Registration may be limited, closed, refused, or canceled when reasonably necessary for security, capacity, legal compliance, or event administration. Unless expressly stated otherwise, registration for “Buy Smart. Sell Strong.” is free.
3. Educational Information Only
Workshop materials and presenter statements are provided for general educational purposes. They are not a substitute for personalized real estate, mortgage, financial, legal, tax, insurance, construction, or other professional advice. Information may not apply to your facts, property, finances, jurisdiction, or market conditions.
No presenter, sponsor, or registration provider guarantees a loan approval, interest rate, property outcome, transaction result, cost estimate, return on investment, or other result. Before acting, consult an appropriately licensed professional and independently evaluate your circumstances.
4. Independent Presenters and Organizations
Empire Builder Hub provides registration technology and event support. Kelley Simms, James Gillespie, Troy Squires, and their respective companies may be independent professionals or organizations responsible for their own statements, services, licenses, disclosures, and follow-up. Participation in the workshop does not by itself create an agency, brokerage, lender, contractor, fiduciary, or other professional-client relationship.
5. Communications
By registering, you agree to receive operational email messages reasonably necessary to provide confirmation, access information, event changes, and support. Promotional email may be sent only as permitted by law, and you may use the unsubscribe link included in those messages.
If you separately opt in to text messages, you agree to receive workshop-related texts, including confirmation, access information, reminders, and relevant follow-up. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Your carrier is not responsible for delayed or undelivered messages.
6. Zoom and Other Third-Party Services
The workshop may use Zoom and other services operated by third parties. Your use of those services is also subject to their terms and privacy practices. We are not responsible for third-party service interruptions, device compatibility, internet access, carrier performance, or unauthorized actions outside our reasonable control.
7. Acceptable Use
You may not misuse the page, registration form, event, or access information. Prohibited conduct includes disrupting the workshop; attempting unauthorized access; introducing malicious code; impersonating another person; scraping or collecting attendee information; recording, reproducing, or redistributing event content without permission; or using the services in violation of law or another person’s rights.
8. Intellectual Property
Unless otherwise indicated, page content, workshop materials, graphics, recordings, trademarks, and logos belong to their respective owners and are protected by applicable law. Registration gives you a limited, personal, nontransferable right to attend and view the workshop. No other license is granted.
9. Event Changes and Availability
Event dates, times, presenters, topics, access methods, and availability may change. We may postpone or cancel an event and will use reasonable efforts to notify registered attendees using the contact information provided. We do not guarantee uninterrupted or error-free access.
10. Disclaimer of Warranties
To the fullest extent permitted by law, the event pages, registration services, workshop, and materials are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
11. Limitation of Liability
To the fullest extent permitted by law, Empire Builder Hub, the presenters, sponsors, and their respective owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the page, registration, workshop, materials, third-party services, or decisions made based on workshop information. Any liability that cannot lawfully be excluded remains limited only to the extent allowed by applicable law.
12. Governing Law and Venue
These terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any dispute not subject to a mandatory legal process will be brought in a court of competent jurisdiction serving the St. Louis, Missouri area, unless applicable law requires otherwise.
13. Severability and Waiver
If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
14. Changes to These Terms
We may update these terms as event practices, services, or legal requirements change. The effective date at the top identifies the latest revision. Continued use after an update means you accept the revised terms to the extent permitted by law.
